KAMPALA, UGANDA — September 5, 2026: Kampala businessman and socialite Bryan Kirumira, popularly known as Bryan White, has been granted mandatory bail by the High Court after spending 293 days in custody without being committed to the High Court for trial.

Justice Gadenya Paul Wolimbwa ruled that Kirumira had acquired a constitutional right to mandatory bail after remaining on remand beyond the 180-day period provided under Uganda's Constitution for an accused person facing an offence triable only by the High Court. The judgment was delivered on September 3, 2026.
Why the Court Granted Bail
According to the judgment, Bryan White had spent 293 days on remand, meaning he had remained in custody for 113 days beyond the 180-day constitutional period without being committed to the High Court.
The court held that once the constitutional threshold was reached, mandatory bail became an entitlement. The seriousness of the charges could not, by itself, override that constitutional right.
The prosecution had opposed his release, citing concerns including possible interference with witnesses and investigations and the possibility that he could abscond. The judge, however, found that such concerns could be addressed through appropriate bail conditions.
Shs10 Million Cash Bail
The court ordered Bryan White to deposit Shs10 million in cash and provide two substantial sureties, each required to execute a non-cash bond of Shs50 million.
The sureties must be vetted and approved by the Deputy Registrar of the High Court's Criminal Division before his release is completed.
🚫Strict Conditions Imposed
Although granted bail, Bryan White remains subject to several restrictions.
He must:
Surrender his passport and travel documents.
Remain at a fixed address approved by the court.
Not leave Uganda without court permission.
Avoid the premises in Badongo Village, Salaama Parish, identified by prosecutors as the alleged scene of the offence.
Avoid contacting prosecution witnesses, members of the deceased's family and his co-accused.
Continue reporting to the Makindye Chief Magistrate's Court according to the existing schedule.
The court also allowed him to seek medical treatment from a medical practitioner of his choice and at his own expense.
Bail Does Not Mean Acquittal
The granting of bail does not mean Bryan White has been found innocent or acquitted.
He remains charged in connection with the death of 25-year-old Carol/Caroline Nalubwama. The charges reported against him include human sacrifice, manslaughter, rash and negligent acts, possession of a narcotic drug, conspiracy to commit a felony and giving false information. The allegations remain matters for determination through the judicial process.
What Happens Next?
The case will continue before the Makindye Chief Magistrate's Court, including the process of committing the matter to the High Court for trial.
The High Court's ruling has also highlighted the importance of Uganda's constitutional protection concerning prolonged detention before trial.
